Cerebral palsy verdict could close hospital

“Tyrone Hospital said in a court petition filed Monday that it will declare bankruptcy or close its doors if a Blair County judge does not reduce a $4 million verdict awarded by a jury two weeks ago.” Read the rest here.

The ramifications are unfortunate, but that begs the question. Was there malpractice and was the verdict justified? If so, the penalty is the price to be paid for incompetence. Sympathy plays no part in a civil verdict.

The little sound bite we have doesn't give enough details to reach a conclusion. Over at Kevin's blog there's some discussion about causation. I'm not an Ob/Gyn, but there seems to be some opinion that cerebral palsy is related to conditions associated with gestation and not delivery. Maybe some readers more knowledgeable than I am could comment.
